Waiver / liability release

What is child abuse?

Generally speaking, child abuse is injury of a child by an adult or older child that might not be intentional but is not accidental. It is usually classified as physical abuse, emotional abuse, or sexual abuse. Harm caused by withholding life’s necessities—food, clothing, shelter, medical care, education—is called neglect.
What should I do if I suspect that a child is being abused?
Contact the proper authorities immediately. If you suspect a child is being abused, you must contact your local child abuse hotline or the child protective services and law enforcement agencies in your area. Generally, the telephone number to report child abuse is listed in the white pages under “child abuse.” If you suspect a child is in immediate danger, the local police agency should be contacted first. If the suspect is a volunteer, student or instructor of Gracie University or a Certified Training Center, notify the Gracie University Headquarters AFTER the police have been notified.
How do I know what my reporting responsibilities are?
Every state, the District of Columbia, and the U.S. territories have different reporting requirements, and I agree to confirm same for my State. People are often concerned about being sued for reporting child abuse. You are not required to know for certain that a child has been abused. All that the law requires is that you have a reasonable suspicion and are reporting in “good faith.” When these requirements are met, all states provide immunity from liability for child abuse reporters.
Youth Protection Policies and Procedures
  1. All volunteers, students and instructors agree not to violate any third party’s rights in the manner outlined above or otherwise. Volunteers, students, and instructors accused of abuse will be placed on suspension with Gracie University and/or a Certified Training Center until local authorities complete their investigation. Suspension includes no allowance or participation at or near the Gracie University Headquarters, any Certified Training Center (including their own, if suspect is an owner) or any event.
  2. If found innocent of all accusations, all privileges will be reinstated. If found guilty all association membership will be revoked.
I HAVE READ AND UNDERSTOOD THE POLICIES LISTED ABOVE AS INDICATED BY MY SIGNATURE BELOW. My signature on this document is evidence that I know and understand this document and have had this document and its requirements explained to me to my satisfaction, that I fully understand and agree to fully comply with the Youth Protection procedures described above and that I voluntarily certify that I will defend, indemnify and hold harmless Gracie Global, LLC. and its affiliates, successors, licensees and assigns, Gracie Global, LLC., all members of the Gracie family, and all of the foregoing officers, directors, managers, employees, contractors, agents and representatives (all collectively the “Gracie Indemnities”) from and against any and all claims, actions, suits, damages, costs and expenses (including reasonable attorneys’ fees and court costs, whether or not litigation is commenced) arising out of or in connection with my breach or alleged breach of any of my agreements hereunder, and that I will not hold any of the Gracie Indemnities responsible for any claims, actions or suits brought against me, as a result of or in association with any claim of my not abiding by the above mentioned Policies and Procedures.  In addition, I agree to the additional policies applied to volunteers, students or instructors of the Gracie Jiu-Jitsu Academy presented at the time of registration, during instruction, as well as any future changes implemented.
